K & M Rentals Inc Equipment Rental Agreement

K & M RENTALS INC is in a contract with the Renter, who is authorized to use the equipment, agrees to be subject to all the terms and conditions set forth in this Rental Agreement, as of this date and time, by going forth with this reservation.

The Renter agrees that:

1: The rented equipment is the sole property of K & M Rentals Inc. and is supplied in good condition. The Renter will return the equipment in the same condition, as when it was received, at the end of the rental period, for inspection and battery recharge, (if applicable), or sooner, if so requested by K & M Rentals Inc.

2: The Renter should use equipment for the stated period time and solely for the purpose for which the equipment was manufactured. If the stated period of use requires changes, it is the responsibility of the Renter to contact K & M Rentals Inc to make changes, failure to adjust the rental contract to the actual time period of use may result in extra fees.

3: K & M Rentals Inc. or one of its authorized agents may repossess the contracted equipment, upon demand at any time, if it is discovered that the equipment is being used in violation of the terms of this agreement, or in any way that may cause harm to the renter or any other person.

4: All restrictions are cumulative and each shall apply to every use of equipment, operation of equipment, or driving of mobility equipment, under no circumstances shall equipment be used in an unsafe manner, or in a manner that may cause injury or harm nor whilst under the influence of intoxicants or narcotics. Persons under the age of 18 years may not ride on, sit on, or operate the drivable mobility equipment in any capacity.

5: K & M Rentals Inc. requires drivers to operate the rented equipment with all reasonable care, attention, due diligence and at all times to fully comply with the terms of this agreement. Renter shall notify K & M Rentals Inc immediately of any and all accidents, damage or injury resulting from the use, operation or driving of the rented equipment.

6: Renter agrees to pay all costs, expenses and legal fees, that may be incurred by K & M Rentals Inc. in the collection of any outstanding sums due to them, in regaining possession of the mobility equipment, or in the enforcement or recovery, for any damage, losses or claims levied against the renter or the renter’s representative. The renter agrees to pay the fee of $100.00 for equipment left in a hotel room or inside a villa or $100.00 for regaining possession of equipment from a theme park and its affiliated hotels.

7: Renter assumes all costs and expenses of every kind and nature, including, but not limited to legal fees and disbursements, arising out of and in conjunction with the use of equipment and or driving of the mobility equipment.

8: Renter shall defend, hold harmless and indemnify, K & M Rentals Inc. and all of their agents, employees and officers, from and against any and all such losses, damages, demands, injuries, liability claims, actions and causes of action, whatsoever, that may arise, or have arisen, related to any damage, loss or injury, claimed by persons, from the use, operation, or driving of the mobility equipment, provided that such a loss, damage or injury, was not caused by the fault or gross negligence or wilful misconduct of K & M Rentals Inc one of its employees or authorized agents.

9: K & M Rentals Inc. shall not be held liable or deemed responsible for any damage to or the loss of any property, lost, left, stolen, damaged, stored or transported by the Renter, its agents or employees or any other person on or using the rented equipment, either before, during or after returning the equipment. Renter assumes all risk of such loss or damage and waives all claims against K & M Rentals Inc. Renter agrees that K & M Rentals Inc. will be held harmless from, to defend and indemnify against all claims based upon or arising out of such loss or damage.

10: Renter assumes all risk and full liability for any loss, damage, injury or death, to persons or property of renter, or others arising out of the use or misuse, operation or driving of the mobility equipment

11: Accidental Damage Insurance is selected by default on this product. By deselecting insurance, you are agreeing with the terms and conditions set forth here. The Accidental Damage Waiver insurance is offered for an additional premium, when making your reservation, should this insurance not be selected, renter agrees to reimburse K & M Rentals Inc. or its authorized agents or representatives, upon demand, for part or as necessary, full replacement value, for any damage to or destruction of the mobility equipment, the renter acknowledges, agrees and authorizes K & M Rentals Inc. to charge the credit card used for any relevant repair costs or if required, the full replacement of the mobility equipment, Loss or theft of the equipment is not covered by the Accidental Damage Waiver and the equipment remains the liability of the renter until its return to K & M Rentals Inc.

12: K & M Rentals Inc. assumes no liability or responsibility for any acts or omissions of Renter or Renters agents, representatives, or employees.

13: Renter or the driver of the mobility equipment shall in no way be deemed to be an agent or an employee of K & M Rentals Inc.

14: Any individual, corporation, representative, or other entity, executing this agreement in any capacity, shall be bound personally, jointly and severally, to all obligations, expressed or implied, arising hereunder, if any provisions stated, or the implication of any provisions, to any person or circumstance, is held invalid or unenforceable, the remainder hereof and the application of such provision to other persons, or circumstances shall remain valid and therefore enforceable.

15: All discounts must be mentioned at time of booking.
